Return & Refund Policy: All Sales Final

Policy Overview

Due to the custom nature, significant expense, and logistical complexity of Mobile, Manufactured, and Modular Homes, Mustang Homes and Land operates under a strict All Sales Final policy.

By submitting a deposit, down payment, or full payment, the buyer acknowledges and agrees to the terms outlined below.

1. No Returns or Exchanges

Once a purchase agreement is signed or funds are exchanged, the sale is considered final.

  • We do not accept returns of homes for any reason, including but not limited to buyer’s remorse, site unsuitability, or design preference changes.
  • We do not offer exchanges for different models once an order has been placed with the manufacturer.

2. Non-Refundable Policy

No refunds are issued for any funds received.

  • Deposits & Down Payments: All deposits and down payments specifically secure the pricing and production slot for your home and are 100% non-refundable.
  • Full Payments: Once full payment has been made (whether cash or funded finance), no refunds will be issued.

3. Deposit Refund Rights Under Texas Law

Notwithstanding any other provision of this policy, deposits (as distinguished from down payments under an executed sales purchase agreement) are subject to refund in accordance with applicable Texas law, including Texas Occupations Code § 1201.151 and Texas Administrative Code § 80.32(k). Under these provisions:

  • A retailer must refund a consumer’s deposit no later than the 15th day after the date a written request for the refund is received from the consumer.
  • A deposit may be retained only if all of the following conditions are met: (1) the consumer specially ordered a manufactured home from the manufacturer that was not in the retailer’s inventory; (2) the home conforms to the specifications of the special order and any representations made to the consumer; (3) the consumer fails or refuses to accept delivery and installation; and (4) the consumer was given conspicuous written notice of the requirements for retaining the deposit.
  • Even when a deposit may be retained under the above conditions, the retailer may not retain more than five percent (5%) of the estimated cash price of the specially ordered home and must refund any amount exceeding that threshold.
  • Upon execution of a sales purchase agreement, a deposit becomes a down payment. A retailer must refund a consumer’s down payment in full if the consumer exercises their right of rescission no later than three (3) business days after the date the applicable contract is signed.
  • When accepting a deposit, the retailer will provide the consumer with a written statement setting forth: (1) the amount of the deposit; (2) a statement of any requirements to obtain or limitations on any refund; and (3) the name and business address of the person receiving the deposit.

To the extent any other provision in this policy conflicts with applicable Texas law governing the refund of deposits for manufactured homes, the requirements of Texas law shall control.

4. Exceptions & Management Discretion

We understand that unique or extraordinary circumstances may arise.

  • Deviations from this “No Refund” policy are rare and are not guaranteed.
  • Any exception to this policy must be negotiated outside of standard operating procedures and requires express written approval and signature from Company Ownership.
  • Sales representatives and general staff are not authorized to approve refunds or cancellations under any circumstances.

5. Warranty & Defects

While refunds are not issued, your purchase is protected regarding quality and craftsmanship.

  • Manufacturer Warranty: New homes are covered by the Manufacturer’s Limited Warranty.
  • Repairs, Not Refunds: Any defects, structural issues, or cosmetic damage found upon delivery or occurring post-installation will be remedied through repair or replacement of parts in accordance with the warranty. The existence of defects does not qualify the home for a return or a refund.
